KIJCK. makelaars is a company dedicated to assisting people in the sale of their homes. For this we need information. In this service to customers we process a multitude of personal data. In this privacy statement you can read how we handle your data. We are responsible for protecting your personal data as well as possible. In doing so, we must comply with the requirements of the privacy regulations. We want to be transparent about the types of data we process, the purposes for which we process data, with whom we share data and what rights you have regarding your own data. THE LEGAL GROUNDS ON WHICH WE PROCESS YOUR DATA
We use at least one of the following grounds for processing your personal data:
To enter into or perform a contract with you;
The ability to comply with a legal obligation incumbent on us, for example, to comply with our legal duty of care during the term of a service that has come about through our mediation or to comply with legal time limits for the retention of data;
The express consent you have given us to process data for specific purposes. You can always revoke this consent;
For the protection of our legitimate interests in the context of our business operations or those of a third party. In doing so, we always balance your interests against ours. Our interests include the careful execution of agreements with you, maintaining and possibly expanding our customer relationship (marketing, etc.). Our legitimate interests are described in this privacy statement.

INSPECTION, CORRECTION AND REMOVAL
You have the right to inspect, correct or remove personal data that we have about you. You can also object to the processing of your personal data (or part thereof) by us or one of our processors. You also have the right to have the data you have provided us with transferred to yourself or directly to another party if so desired. We will ask you to identify yourself before we can comply with the aforementioned requests.

We will respond in principle within four weeks to a request for inspection or correction. In the event of a request for removal, we will remove the personal data concerned as soon as possible, unless and to the extent that the law requires us to retain the personal data concerned or there are (other) compelling reasons that oppose removal. If we cannot comply with a request, we will let you know with reasons.

EXTERNAL PARTIES
In a number of cases we provide your information (where necessary) to external parties, such as notaries, NVM and lenders. However, we will never sell your data to such parties. They may only use or process your data for the agreed purpose. Data collected through cookies may be shared with the parties that place those cookies. Read more about this in our cookie policy. We may also be legally required by government agencies or other parties to hand over your data, such as the Tax Office or Justice Department. We will then only share the data that is strictly necessary.

WHERE YOUR DATA IS STORED
To obtain and store certain data, we work with various applications. To ensure your privacy, these applications are bound by strict rules. We naturally make the necessary agreements with the parties (processors) who provide these applications to guarantee the security of your personal data. Most data is stored within the European Union. For the data that is sent outside the EU, we only work with parties that offer sufficient protection according to the European rules. For a number of countries this has been established, for example for American parties that fall under the ‘EU-US Privacy Shield’. SECURITY
We have taken appropriate technical and organizational measures to protect your personal data from unlawful processing. For example, we have taken the following measures organization-wide:
agreements have been made with every employee about the safe and honest handling of your data;
Our employees only use mobile devices which are under their control and which, in the event of loss, can be remotely erased by a designated authorized person. Devices at fixed workstations are automatically erased after logging out;
logical password protection, such as compulsory PIN codes and strong passwords on all business data carriers;
our offices have locked paper bins for confidential paper;
only secure internet and network connections are used, which are not accessible to third parties;
we work where possible with a customer portal so you can view and edit your data immediately after logging in and you do not need to send it by mail or post. In this way we prevent unnecessary processing and possible input and transfer errors;
We have processing agreements with parties who process data for us;
We have a strict ict policy.

RETENTION PERIOD OF PERSONAL DATA
Your data will be kept for as long as necessary for purposes specified in this privacy statement and to the extent necessary for compliance with legal obligations and for the resolution of any disputes.

WEBSITE
We use functional, analytical and tracking cookies on our website. A cookie is a small text file that is stored in the browser of your computer, tablet or smartphone when you visit this website for the first time. KIJCK. makelaars uses cookies with a purely technical functionality. These ensure that the website works properly and that, for example, your preferences are remembered. PRIVACY STATEMENT – REAL ESTATE
WHAT DATA ARE RECORDED BY NVM-BROKERS?

YOU ARE SELLING YOUR HOME AND HAVE ENGAGED A NVM-BROKER TO DO SO
We collect the data on the basis of entering into or executing an agreement with you and to be able to comply with a legal obligation, such as the WWFT. The purpose of this contact is to promote your home on your behalf, to gain insight into the value of and interest in your home, to show interested parties around and to negotiate on your behalf and to guide the transaction. In doing so, the NVM estate agent also establishes your identity. The following data may be processed:

Your name, address, place of residence and contact details such as your telephone number and e-mail address;
details which are necessary if a legal test must be performed in the context of the Money Laundering and Terrorist Financing (Prevention) Act (Wwft), such as your date of birth, place of birth, nationality, proof of identity with number, place of issue and date of issue;
the reason for the sale or rental, e.g. larger home or change of job;
the date of registration of the property and the period that the property is or has been for sale or rent;
the description and characteristics of the property such as the asking price or rent, the year of construction, the surface areas and layout, cadastral data and the WOZ value
Photos and videos of the property;
the reason for any withdrawal of the brokerage assignment;
data necessary to draw up the purchase contract, including your identification;
when the property is sold or rented: the transaction data such as the sale or rental price and the transaction date;
an IBAN account number for payment of your bills;
other information that you provide to your NVM Estate Agent.

YOU WANT TO BUY A HOUSE THAT IS OFFERED VIA THE NVM-BROKER
We collect the data on the basis of entering into or performing an agreement with you, legitimate interest and to be able to comply with a legal obligation, such as the WWFT.

For this contact, the NVM broker is in contact with you and possibly your broker in connection with the bidding process. Thereafter, the NVM real estate agent carries out the preparatory activities for the purchase contract and the transfer. In this contact, the NVM estate agent also establishes your identity. The following data may be processed:

your name, address and contact details such as your telephone number and e-mail address;
your opinion about the house;
data concerning the offers;
data which are necessary if a legal test must be carried out in the context of the Money Laundering and Terrorist Financing (Prevention) Act (Wwft);
If agreed with the seller, data to determine your ability to pay a purchase price or meet other requirements of the seller. This is a legitimate interest of the seller;
data necessary to draw up the purchase contract, including your identification;
when the house has been sold: the transaction data such as the selling price and the transaction date and also zip code of the previous residential address of the buyer;
other information that you provide to the NVM agent.

YOU WANT TO BE KEPT UP TO DATE, WITHOUT OBLIGATION, ABOUT THE OFFER BY THE NVM AGENT
We collect the information based on the permission you give us. The purpose of this contact is that the NVM agent notifies you of homes, business premises or agricultural property that may be of interest to you. This happens until the moment you indicate that you no longer require this service. The following data may be processed:

Your name, address and contact details such as your telephone number and e-mail address;
The search profile in which your housing requirements are included. An offer can be compiled on the basis of the search profile;
Other information that you provide to the NVM agent.

YOU WANT TO HAVE A HOUSE APPRAISED AND YOU HAVE ENGAGED THE NVM-BROKER/APPRAISER FOR THIS PURPOSE.
The purpose of this contact is for the NVM estate agent / appraiser to perform a valuation of your home, commercial property or agricultural property. The following data may be processed:

Your name, address and contact details such as your telephone number and e-mail address;
details of your home, business premises or agricultural property to determine the value;
an IBAN account number for payment of your invoices;
other information that you provide to your NVM broker/appraiser.

DATA USE BY THE NVM
The NVM broker provides certain data to the NVM via a link. NVM is the processor responsible for the data received. The NVM does the following with these data:
Ensure that all NVM estate agents have an up-to-date offer of houses, commercial premises and agricultural property which are offered via NVM estate agents.
Ensuring that the current offer is placed on Funda and other (housing) websites.
Providing a database enabling valuations and other appraisals and insights into developments in the housing market, the commercial real estate market and the agricultural real estate market.

A – ACTUAL SUPPLY OF HOUSES BY NVM-BROKERS
If you want to sell a house via an NVM estate agent, the following details will be disclosed to other NVM estate agents:

The address of the house, the description and characteristics of the object such as the asking price, year of construction, surface areas and layout, land registry data, WOZ value and photos of the object;
Date that the property comes on the market, date that the property is taken off the market. Sale subject to conditions, date of sale and transaction price.

These data are used by NVM estate agents for the provision of services to their clients (those looking for a house, business premises or agricultural property).

These data are stored indefinitely in connection with the database of historical offers, see under C.

B – CURRENT HOUSING OFFERS ON (HOUSING) WEBSITES, INCLUDING FUNDA
If you want to sell a house through an NVM agent, after consultation with you data will also be published on Funda and other (housing) websites. This concerns the following data:

The address of the house, the description and characteristics of the property such as the asking price, year of construction, surface areas and layout, land registry data, WOZ value and photos of the property.
Date that the object comes on the market, sale date.

This information is used to bring your object to the attention of consumers, professional parties and/or third parties who are searching via (housing) websites themselves. You give your NVM agent permission to do this or not.

This information may still be visible on these websites up to one year after the date of sale or the date on which a house is taken off the market.

C – DATABASE WITH HISTORICAL OFFERINGS
For all houses that are sold via an NVM estate agent, the following data is recorded in the NVM database:

The address of the house, the description and characteristics of the object such as the asking price, year of construction, surface areas and layout, land registry data, WOZ value and photos of the object;
Date that the property comes on the market, date that the property is taken off the market. Sale subject to reservation, date of sale and transaction price;
The postal code (1234AB) of the buyer’s previous (residential) address.
The aforementioned data will be kept for an indefinite period of time.

NVM uses the aforementioned data to make analyses of the housing market possible. The NVM provides these data to selected third parties, namely:

Appraisers, in order to make appraisals and other value assessments;
Validation institutions, in order to check valuation reports;
Municipalities, for determining WOZ values;
The Ministry of Infrastructure and the Environment, for research into the housing market;
Universities, for research purposes;
NVM estate agents in the context of providing services to their clients;
Non-NVM brokers, banks, project developers and housing corporations, for research purposes (e.g. the housing need in a certain region);
These parties only have access to data for the purposes stated and where possible data is only provided at an aggregate level.

PURPOSES OF PROCESSING?
We process your personal data aimed at, among other things, the following activities in our business:

Assessing and accepting potential customers;
Managing our relationship with (potential) customers and visitors;
Managing our customer database;
Concluding and executing agreements;
Performing analyses of personal data for statistical purposes and for archiving purposes;
to comply with legal obligations;
Sending newsletters or information of a specific nature.
